Frequently asked questions
- How is overtime pay calculated?
- Each hour over 45 per week is paid at the hourly wage plus 50% (Labor Law m.41). The hourly wage is the monthly gross wage divided by 225: with a gross wage of 45.000 TL, the hourly wage is 200 TL and one hour of overtime is 300 TL.
- How much is paid for working on a weekly rest day?
- For each weekly rest day worked, 1,5 days' wages are paid in addition to the daily wage already included in the monthly wage (Court of Cassation practice). The daily wage is the monthly gross wage divided by 30.
- What is an employee paid for working on national and public holidays?
- An employee who works on a national or public holiday is paid one additional day's wage on top of that day's wage (Labor Law m.47). Religious holiday eves and October 28 are half days; in 2026 there are 15,5 holiday days in total.
- How is unused annual leave pay calculated?
- When the employment contract ends, unused leave days are paid by multiplying them by the daily wage derived from the last gross wage (m.59). Leave entitlement by length of service is 14 days for 1–5 years, 20 days for 5–15 years, and 26 days for 15 years or more; employees aged 18 or under or 50 or over get at least 20 days (m.53).
- What is an equitable reduction?
- When overtime, weekly rest day work and holiday work are proven by witness testimony, courts usually apply a discretionary reduction of 25% to 1/3 to the calculated amount. The law sets no fixed rate; the reduction does not apply when proof is based on written records.
- What deductions are made from these claims?
- Overtime, weekly rest day, holiday and leave pay count as wages. The SGK employee share of 14% and the unemployment insurance share of 1% are deducted; the remainder is subject to progressive income tax and stamp tax. Courts usually award the claim in gross terms.
